1. Introduction
Welcome to MonetizeAI ("Platform"). By accessing or using our AI content generation and print-on-demand platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.
2. Platform Operator
The Platform is provided by MonetizeAI ("we", "us", or "our"). For any questions, contact us at service@monetizeai.pro.
3. Eligibility
You must be at least 18 years old to use the Platform. The Platform is not directed to children under 18. By using the Platform, you represent that you are of legal age to form a binding contract.
3. Electronic Communications & Signatures
- •You consent to receive all communications from us electronically, including via email or in-app notifications;
- •You agree that all electronic notices, disclosures, and agreements satisfy any legal requirement that such communications be in writing;
- •Your electronic agreement (such as clicking 'I Agree' or 'Buy') is legally equivalent to your physical signature on paper.
4. How the Platform Works
The ecosystem operates in two primary phases:
- 1.You subscribe to access our AI tools and generate unique designs;
- 2.Your designs are published on products in the MonetizeAI store;
- 3.Products are manufactured and fulfilled by third-party production partners;
- 4.You earn royalties when products featuring your designs are sold.
5. Subscriptions & AI Credits
MonetizeAI operates on a credit-based subscription system. Specific plans, credit allocations, and pricing are displayed within the App at the point of purchase.
- •AI Credits represent a limited, revocable license to access our AI generation compute resources and have no cash value.
- •Credits are consumed upon the initiation of a generation request, regardless of the aesthetic outcome.
- •Unused credits roll over to the next billing cycle as long as an active subscription is maintained.
- •Refunds will not be issued based on subjective dissatisfaction with generated results, as you are paying for the compute attempt.
- •Subscribing confers access to commercial usage rights for the resulting designs, subject to Section 9.
6. Billing & Platform Payments
In-app purchases and subscriptions are processed via the Apple App Store or Google Play Store ("App Stores").
- •All payments are handled by the respective App Store and are subject to their specific terms and conditions.
- •Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
- •You must manage or cancel your subscription directly through your App Store account settings.
- •We reserve the right to adjust pricing or credit allocations with 30 days prior notice.
- •Any fraudulent or bad-faith chargeback initiated against a subscription payment may result in account termination and forfeiture of all balances.
8. Creator Royalty Program
When products featuring your designs are sold, you earn royalties:
- •Royalty rates are published on our Royalty Schedule;
- •MonetizeAI has sole discretion to set and modify royalty rates with 14 days' notice;
- •Royalties are only payable if and after we receive funds from fulfillment partners;
- •There is no guarantee of sales or income.
9. License Grant
By publishing designs through the Platform, you grant MonetizeAI:
- •A perpetual, non-exclusive, worldwide, royalty-free license to sell products featuring your designs;
- •The right to use your designs and shop name in platform marketing and promotions without further approval;
- •The right to sublicense to manufacturing and fulfillment partners;
- •You retain copyright ownership of your original designs, and this license is non-exclusive.
10. Payouts (Royalty Payments)
Payments are subject to these administrative terms:
- •Minimum Payout: $10.00 USD minimum balance required for payout.
- •Payout Method: Exclusively via PayPal to your verified email address.
- •Frequency: Processed monthly, approx. 60-90 days after sale to account for returns.
- •Dormant Accounts: Accounts inactive for 12+ months may be charged a $2.00 monthly fee.
- •Tax Responsibility: You are an independent contractor responsible for all taxes.
11. Acceptable Use & AI Safety
- ✕No generation of deepfakes or unauthorized celebrity likenesses;
- ✕No generation of harmful, defamatory, or hateful content;
- ✕No reverse-engineering of our prompts or training competing models;
- ✕No automated scraping or bulk account creation;
- ✕You accept all designs 'as-is' regarding aesthetic quality and AI artifacts.
12. Service Availability & Liabilities
- •We are not responsible for delays or failures caused by third-party APIs or factories.
- •To the fullest extent permitted by law, MonetizeAI disclaims all warranties.
- •Total liability shall not exceed the greater of $100 or total royalties paid in the preceding six months.
13. Termination
- •We reserve the right to terminate any account for any reason or no reason.
- •Upon termination, access to AI credits ceases immediately.
- •Royalty balances under the minimum threshold may be forfeited upon closure.
14. Mandatory Arbitration & Class Action Waiver
- •Any dispute shall be resolved through binding, individual arbitration.
- •You expressly waive any right to participate in a class-action lawsuit.
- •Claims must be brought only in your individual capacity.
